EU Whistleblowing Directive

By December 17, 2021, the EU Member States need to implement the EU Whistleblower Directive into national law. As of today, protection of whistleblowers is heavily fragmented across the EU Member States. The Directive aims at creating a certain minimum level of harmonized rules across all 27 EU Member States while at the same time giving Member States the right to extend the scope of the Directive by more favorable provisions. 

The Directive requires businesses operating in the European Union to meet a certain threshold, which on some topics goes beyond what is currently known as the market standard. Global businesses operating in the European Union will need to examine their existing whistleblowing policies and procedures against what is contemplated under the Directive and respective national laws. Due to the Directive, one can reasonably expect increased legislative activity in the area of whistleblowing laws within the next few months across EU Member States, aimed to implement the Directive. If a Member State fails to implement the Directive by the December deadline, whistleblowers may nevertheless invoke the benefit of the Directive under certain circumstances.
