Biography
Allan Braxdale joined the Dallas office in 2013. Allan's practice focuses on patent prosecution, patent litigation support, and transactional matters across a diverse range of technologies, including:

Patent Prosecution and IP Transactional Matters
Allan represents clients in all phases of patent prosecution, from preparing new applications based on invention disclosures to completing the appeals process. While preparing and prosecuting patent applications, Allan works closely with clients to ensure their patents provide strategic protection by, e.g., aligning with current and predicted industry developments, trends, and applicable standards. With respect to patent prosecution, Allan has developed expertise in overcoming patent eligibility rejections (i.e., rejections under 35 U.S.C. § 101) and, in doing so, has obtained favorable decisions for his clients at the Patent Trial and Appeal Board (successfully reversing § 101 rejections). Allan also has significant experience assisting clients with the development and prosecution of foreign patent portfolios and performing freedom to operate analysis.
Allan understands that every client is unique and has different needs (e.g., goals, budgetary constraints, time constraints). To that end, Allan leverages his extensive patent prosecution experience to develop programs designed to identify key areas of innovation, as well as devise strategic approaches to protecting identified innovations consistent with needs of each client.
Allan's transactional experience includes representing clients on due diligence matters in connection acquisitions involving patent portfolios.
Patent Litigation
Allan has experience assisting clients in various phases of patent litigation and related proceedings. Allan's patent litigation experience includes performing infringement and non-infringement analysis, prior art searches, and developing invalidity contentions. Additionally, Allan has experience in preparing inter partes review (IPR) filings and leverages his patent prosecution experience to create strong arguments during all stages of IPRs.
