Norton Rose Fulbright’s award-winning agency finance team focuses on complex, multi-source financings involving export credit agencies (ECAs), development finance institutions (DFIs) and multilateral agencies. Our clients include not only the agencies, but also commercial banks, sponsors and developers who rely on us for innovative financing solutions across a variety of jurisdictions, including all global emerging markets.

ECA practice

Our ECA practice has worked on transactions involving almost every single ECA and we have lawyers frequently on secondment to ECAs and within ECA teams at major banks.

Our ECA practice covers all forms of financing, including Organization for Economic Cooperation and Development (OECD) arrangements; tied and untied financings; due diligence; full faith and credit opinions; compliance of financing documents with ECA requirements; intercreditor issues; and hedging issues. We advise on the full span of financial products offered by ECAs, including buyer credits; supplier credits; and other forms of export and trade related insurance and guarantees.

DFIs and multilateral agency finance practice

We represent, and act on transactions supported by, all the major DFIs and multilateral agencies, including members of the World Bank Group, such as the International Finance Corporation (IFC) and the Multilateral Investment Guarantee Agency (MIGA), the Inter-American Development Bank (IDB), the Asian Development Bank (ADB), the African Development Bank, the European Bank for Reconstruction and Development (EBRD) and a large number of national development banks, as well as users of their various lending, guarantee and insurance programs, and many of the sub-funds they support, such as the Emerging Africa Infrastructure Fund. We are a recognized panel firm for a significant number of DFIs and multilateral agencies, with our relationship with many such organizations extending back for over 20 years.

Our lawyers understand these organizations and their programs, which require the most sophisticated finance advice coupled with sensitivity to their social and environmental policy goals. Around the world, our multilingual team covers key jurisdictions and practices relevant to multilateral agency financing in the most challenging jurisdictions.

Innovation

Innovation is a key component of our agency finance practice. We offer clients the benefit of our award-winning Global ECA Cover CRR 194 Opinion Service, which allows banks to subscribe for cost-effective access to generic legal opinions for the cover products (CRM) of various ECAs and multilateral agencies.
