Managing Chinese data in investigations and disputes

Chinese data protection and evidence-collection rules require special attention and the last few months have only seen these rules grow more complex. Following the China Cybersecurity Law (CSL) enacted in 2016 and the Judicial Assistance Law enacted in 2018, there is now a new Data Security Law (DSL) that came into effect on September 1, 2021 and the much-anticipated Personal Information Protection Law (PIPL) that came into effect on November 1, 2021. The PIPL is China's first comprehensive data protection law and is expected to significantly alter the way multinational companies collect, process, store and transfer personal data in mainland China.
