ESG regulation: Global themes and what's on the horizon

Environmental, social and governance (ESG) is a key area of importance for businesses globally as the legal and regulatory landscape changes and expectations of investors, customers, employees and other stakeholders grow.

• North America: US President Joe Biden has made climate change and environmental justice priorities of his administration, and in Canada ESG regulation continues to be a priority.
• Europe: The European Commission has issued a raft of ESG regulations and there is the question of how far the UK will follow these given that it is no longer a member of the European Union. 
• Asia-Pacific: ESG regulation is also on the rise. In the summer the Hong Kong SFC issued new guidelines on enhanced disclosures for authorised funds.
• Australia: Responsible investing is reaching new heights which is attracting regulatory attention.
