Revisiting Subrogated recoveries in South African Insurance Law and the evolution of damages in medical negligence

This session will be divided into two sections:

• The first section will revisit the doctrine of subrogation and a discussion on recent case law.
• The second section will cover the changing face of the settlement of future medical expenses in negligence matters, with a specific focus on case law which allows for the development of the common law, away from a “once and for all” scenario, to the provision of services and apparatus.
