Supreme Court explains decision to uphold an anti-suit injunction in respect of foreign-seated arbitration

Our international arbitration team have written a briefing note discussing the Supreme Court’s decision in UniCredit Bank GmbH v RusChemAlliance LLC [2024] UKSC 30. The sole issue before the Court was whether the English court had jurisdiction to grant the anti-suit injunction in support of a foreign-seated arbitration. The Supreme Court’s judgment is robust and authoritative, clarifying and resolving some of the issues which have arisen from previous (now somewhat recast) judgments, and has rightly been welcomed as both a pro-contract and pro-arbitration decision.
