The Prompt Payment and Construction Lien Act is the first significant amendment to the Builder’s Lien Act in nearly 20 years. The Act mandates swifter payment timelines and a fast-track adjudication process to address issues of delay and late payment in the construction industry.
The new law applies to anyone agreeing to provide an “improvement” to land in Alberta. This includes owners, developers, architects, and engineers whose contracts are entered into on or after August 29, 2022, or whose contracts are scheduled to remain in effect after August 29, 2024.
