Biography

Yvonne Yap is an energy, resources and infrastructure lawyer based in Perth. She was admitted in the Supreme Court of Western of Australia in 2017.

Yvonne has advised government and corporate clients on regulatory frameworks, regimes and processes associated with the development and operation of major gas and electricity projects in the energy sector. Yvonne's experience includes advising on legislation and regulation governing gas and electricity infrastructure, access and markets in Western Australia and other Australian jurisdictions.

Gas

  • a gas seller – negotiating and drafting a long term, high value gas sales agreement in Western Australia. Advising on shipper processes as applicable to gas sales.
  • a gas seller – on competition law concerns relating to access to gas pipelines.
  • an Australian IPP - on upcoming reforms to gas pipeline regulation pursuant to the National Gas Law and National Gas Rules, including with respect to changes to pipeline classification and related obligations (e.g. access requests and negotiations, and information disclosure requirements).
  • a regulatory body - on gas pipeline regulation, including reviewing access arrangement decisions and statutory interpretation of the National Gas Law and National Gas Rules in Western Australia.

 

Electricity

  • an electricity retailer – advising on the Wholesale Electricity Market (WEM) Rules reforms and subsequent contractual negotiations to address Change in Law.
  • an electricity retailer – advising on competition law considerations in relation to a long term energy supply agreement.
  • an electricity retailer – on negotiating an energy infrastructure design and works agreement; project development for renewable infrastructure, including drafting and negotiating an electricity supply agreement, works agreement, customer engagement document, payment agreement and principal/agency agreement.
  • a network operator – advising on the implementation of novel business solutions, including battery energy storage systems in the South West Interconnected System; supply and abolishment of rural network infrastructure, including drafting of short-form contracts; and negotiating and drafting service provider contracts.
  • an international IPP – advising on entry into the Australian renewable energy market and acquisition of a solar farm and related infrastructure as well as legislative frameworks and associated requirements for the development and operation of renewable power stations in Western Australia, New South Wales and Victoria.

 

Disputes

  • Economic Regulation Authority v Synergy – I acted for Synergy in its defence against an alleged contravention of the WA Wholesale Electricity Market Rules. This matter involved an in-depth analysis of the gas market in WA and market power in electricity markets.
  • Synergy v NewGen Kwinana (an IPP) – I acted for Synergy in a successful appeal relating to the construction of a provision in a tradeable purchase agreement. The consequence of the appeal decision was that Synergy would not liable for payments to the value of $25.5m.
  • Synergy v NewGen Kwinana (an IPP) – I assisted Synergy in commencing proceedings for the repayment of monies by Synergy to NewGen to the value of $16.9m.
