Biography
Michael Jürgen Werner is an antitrust and competition lawyer based in Brussels. He joined us in 2001 as partner, having been a resident partner in a major German law firm in Brussels since 1995. A German-qualified lawyer by background, he is a member of the German, English and Belgian bar.
Jürgen was described in Chambers as follows: “clients are impressed with Jürgen’s 'precision, responsiveness and ability to keep things simple”. According to leading German publications, he is - with his eminent experience in European and Competition Law - “one of the most creative” competition and regulatory lawyers in Brussels.
Jürgen’s main areas of practice include national and EU competition law, EU public procurement and state aid issues, trade law as well as regulatory law. With more than 25 years of experience, he is a leading regulatory advisor in the core sectors such as automotive, energy, industry, transport (aviation, rail, shipping), telecommunication and financial institutions. He advises national governments, governmental bodies (inside and outside the EU) and private operators. He represents clients in respect of the M&A transactions, competition and regulatory compliance, obtaining clearance from competition authorities for merger transactions, cartel and monopoly investigations, regulatory investigations (obtaining authorisations), public procurement and state aid issues.
Since the mid 90’, Jürgen advises from Brussels international companies in relation to EU and international competition law, merger control, Article 101 and 102 TFEU issues including joint ventures, cartel investigations, restructuring and privatisation. He has appeared in cases before the European Commission, the German Federal Cartel Office and the Federal Network Agency as well as other national antitrust authorities in a wide range of sectors. He also appears before European courts, especially the General Court. During a secondment to the German Federal Cartel Office and the Legal Service of the EC Commission, Jürgen gained practical experience working inside the competition authorities.
He has been co-chairing several parliamentary groups (in the German Bundestag) which has been set up to draft a PPP modernisation law, concerning various aspects and aimed at improving legal conditions for the implementation of PPP projects, including rail infrastructure and public procurement. He also advised the Czech and Slovak Government on the compliance of national legislation with EU law.
In addition to his advisory work, Jürgen is a lecturer at a major German University on competition, state aid and public procurement law. He was elected to the Advisory Board of ERA (The Academy of European Law). Furthermore, he is a regular speaker at international conferences on competition and regulatory topics, public procurement and state aid issues. He is also co-author of several leading commentaries on EU competition law and public procurement law as well as author of the competition commentary (Frankfurter Kommentar) about the Technology Transfer Block Exemption regulation.
He is a German native speaker and speaks English, French, Italian and Spanish fluently.
