Biography

Ananya Mitra is an international arbitration lawyer based in Sydney. Ananya is admitted to practice in India and is a Fellow of the Singapore Institute of Arbitrators (SIArb).

‘Incredibly hard working and always helpful and super responsive’ and ‘strong for India-related disputes and investor-state arbitration’ (Legal 500 (2022)), Ananya’s practice includes complex, high-value commercial and investment treaty arbitration with a focus on the energy sector (piped gas, LNG, renewables), pharmaceuticals, joint venture and shareholders disputes, and India-related matters.

Prior to joining Norton Rose Fulbright in Sydney, Ananya worked for another global law firm in Singapore.

  • Representing a Thai energy company in a London arbitration concerning an approximately US$20m claim made against it arising out of an investment agreement for a European asset.
  • Representing a group of oil & gas majors in two significant gas price review arbitrations
  • Acted for an oil & gas major in two precedent-setting multi-billion-dollar LNG price review arbitrations (ICC Rules; English law).
  • Advised an oil & gas major in the second round of price review negotiations under two long-term LNG SPAs with Asian buyers.
  • Advised a European buyer in price re-negotiations following a claim of hardship and invocation of the price review clause under a long-term gas SPA with an African State-owned entity.
  • Advised a European natural gas buyer in a potential ICC arbitration under a long-term gas supply contract with a State-owned entity.
  • Represented the Arab Republic of Egypt in an ICSID arbitration arising from the development of a commercial agricultural project and a new city.
  • Successfully had all claims dismissed, and counterclaims upheld, for two investment funds in a USD10 million HKIAC arbitration related to the acquisition of a pharmaceutical equipment manufacturer.
  • Acted in an ICC arbitration arising out of a licensing and marketing dispute between two European pharmaceutical companies.
  • Second chair (presented opening and closing submissions) in two successful appeals before the Court of Arbitration for Sport arising from corruption and gender discrimination in elections conducted by the Asian Football Confederation.
  • Advised the minority shareholder of a hospital in India in two SIAC arbitrations arising from a rights issue (USD10 million in dispute) with the client securing a favourable award.
  • Advised an Asian steel company in a potential SIAC arbitration arising from the exercise of a put option under a shareholders' agreement (Indian law).
  • Advised on two potential HKIAC arbitrations relating to a thermal power plant in the Philippines.
