Biography

Joshua Rodman’s practice focuses on export controls and sanctions, government contracts and transactions involving the Committee on Foreign Investment in the United States.  

Joshua prides himself on delivering efficient and creative advice to executives in an ever-increasingly complex regulatory environment.  More specifically, his practice focuses on:

  • International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR) classification and compliance; export licensing; export control program reviews, audits and voluntary self-disclosures; and export control training for employees.
  • Office of Foreign Assets Control (OFAC) regulations and sanctions and embargo compliance. 
  • The Committee on Foreign Investment in the United States (CFIUS).
  • 'Buy America' compliance; Build America, Buy America (BABA) compliance under the 2021 Infrastructure Investment and Jobs Act; domestic content requirements under the Inflation Reduction Act of 2022; Buy American Act of 1933 (BAA) compliance; and Trade Agreements Act of 1979 (TAA) compliance. 
  • Negotiating, securing and performing government prime contracts, subcontracts and sub-tier subcontracts; Federal Acquisition Regulation (FAR) compliance; Defense Federal Acquisition Regulation (DFARS) compliance; and US Small Business Administration (SBA) rule compliance.
  • "Made in USA" claims under Federal Trade Commission (FTC) rules.
  • Purchase agreement mark-ups and reviews, performing due diligence and filing of administrative notifications related to corporate transactions involving international trade, CFIUS or government contracting-related issues.

Prior to joining Norton Rose Fulbright, Joshua was a partner at a highly regarded international trade boutique law firm.  He also was previously an associate at an AmLaw 100 firm.  Joshua started his career working for one of the largest defense contractors in the world.

Joshua is admitted to practice before the US Court of Federal Claims and the US Court of Appeals for the Federal Circuit.

  • Assisted company with responding to administrative subpoena from OFAC related to business activities in Russia, which led to a global, multiyear internal investigation on export control and related Electronic Export Information (EEI) violations, followed by final voluntary self-disclosures to the US Department of Commerce's Bureau of Industry and Security (BIS) and US Census Bureau for a multinational manufacturer of semiconductor-related products.
  • Led comprehensive global export compliance audit and export controls program review for aircraft part distributor/exporter.
  • Coordinated with foreign counsel and navigated complex international regulatory landscapes to resolve export control and sanctions issues involving multiple regulatory bodies and jurisdictions, including the United States, European Union and Taiwan, for cybersecurity-related hardware and software.
  • Advised a manufacturer of electrical lighting systems on compliance of company products under BABA requirements of the 2021 IIJA and US federal-agency specific ‘Buy America’ requirements.
  • Advised a government contractor on whether its products complied with the BAA and TAA.
  • Submitted a bid protest on behalf of a technology company that was eliminated from competition for a Navy Small Business Innovative Research (SBIR) Phase II contract due to alleged foreign ownership.
  • Defended a US government contractor/exporter in subpoena requests and investigations brought by US regulatory agencies, including BIS and OFAC, related to its export activities.
  • Provided advice to a financial institution on compliance with U.S. and international economic sanctions related to movement of monies out of Russia after the 2022 invasion of Ukraine, including obtaining a license from the US Treasury Department's OFAC.
  • Assisted a technology client with classifying products and technologies under EAR and ITAR, and advised on attendant export licensing and export control compliance requirements.
  • Developed and implemented a comprehensive training program for a clean energy client on export controls, sanctions, and government contracting compliance; conducted workshops and seminars to educate employees on regulatory requirements and best practices.
  • Advised on a transaction involving foreign investment in a US software company, guiding the client through the CFIUS review and filing process.
  • Represented a manufacturer of imported spa equipment in an FTC/Made in USA investigation.
