The No Surprises Act (“Act”) was enacted on December 27, 2020 as part of the Consolidated Appropriations Act of 2021 to address “surprise medical bills” received by consumers and provide protections for consumers accessing services at an out of network provider. Two sets of regulations along with several sets of FAQs and guidance documents have been issued in its wake. Implementation of these rules and navigating the regulatory framework has raised both practical and operational challenges and questions for providers.
