On August 31, 2020, the Morena political party presented its legislative agenda to the Senate for the first ordinary period of sessions to be held from September 2020 to January 2021.

The legislative agenda is composed of various matters, including (i) the COVID-19 outbreak; (ii) the rule of law, security and justice; (iii) transparency and anti-corruption; (iv) human rights; (v) social well-being and poverty; (vi) environment; (vii) economy and the financial system; (viii) amendments to the federal legislative branch; (ix) foreign policy; and (x) international instruments.

The agenda mentions matters of interest that could have an impact on the energy sector, such as:

  • Comprehensive energy reform;
  • An amendment to the PEMEX Law (Ley de Petróleos Mexicanos) aimed to reinforce its leading role in the market so that PEMEX can develop alternative energy projects other than hydrocarbons;
  • An amendment with respect to PEMEX, as a productive state company, centers on economic growth and oil revenues;
  • An amendment to the Hydrocarbons Law (Ley de Hidrocarburos) concerning national content obligations, and one that seeks to specify allocations and contracts conditions; to eradicate all types of corruption; and a modification to the management, administration and regulation of Integrated Systems;
  • Amendment to the Hydrocarbons Income Law (Ley de Ingresos sobre Hidrocarburos) to ease PEMEX's fiscal situation and to seek to improve its financial position. Likewise, it intends to implement a Specific Tax Regime for Non-Associated Natural Gas;
  • Seeking an amendment to various provisions of the Organic Law of the Attorney General's Office (Ley Orgánica de la Fiscalía General de la República) to create a Specialized Prosecutor's Office for the Prosecution of Crimes Committed in the Hydrocarbon Industry;
  • A proposal to amend the Law to Prevent and Sanction Crimes Committed in the Hydrocarbons Sector (Ley para Prevenir y Sancionar los Delitos Cometidos en Materia de Hidrocarburos) so that the crimes contained therein may be pursued ex officio by the Attorney General Office;
  • And finally, an amendment is proposed to the Law of PEMEX (Ley de Petróleos Mexicanos), the Law of the Federal Electricity Commission (Ley de la Comisión Federal de Electricidad) and the Law of the Mexican Petroleum Fund for Stabilization and Development (Ley del Fondo Mexicano del Petróleo para la Estabilización y el Desarrollo), with respect to officers appointments

It is worth mentioning that the content of this agenda is indicative of the orientation of the energy policy followed by this administration.
