Immunity for criminal conduct in undercover investigations to be granted to a wide range of UK authorities

After a protracted passage through Parliament, the recent Covert Human Intelligence Sources (Criminal Conduct) Act 2021 has received Royal Assent. When it comes into force, it will enable a wide range of UK government authorities (including HMRC, the FCA, the SFO and the CMA) to authorise criminal conduct by individuals in undercover operations with immunity from prosecution. Such significant express statutory powers have not previously been available to them and raise concerns about how they will be exercised.
