A battle on termination and guidance from the Court on the right to relief from forfeiture

Our disputes and transport teams have written a briefing note discussing the recent High Court decision in FW Aviation (Holdings) 1 Ltd v Vietjet Aviation Joint Stock Company [2024] EWHC 1945 (Comm). In this dispute around the enforcement of leasing agreements for airbus aircraft, the Court had to consider if the lease had been validly terminated, the meaning of “financial institution” within the lease agreement, and if the defendant was entitled to forfeiture.
