Biography
Zhener Low is an adept, bilingual commercial litigator with a bi-coastal practice. She has a particular strength in navigating clients through complex disputes with an Asian element. Before shifting her practice to the US, she was a commercial litigation and international arbitration lawyer in a leading Singapore law firm, forming strong Southeast Asian connections which she continues to serve and maintain from the US. Zhener is triple-qualified in California, New York and Singapore. She is also fluent in spoken and written Mandarin Chinese.
Zhener’s practice covers a variety of subject matters and industries. She has particular experience in litigating disputes with a white-collar angle such as D&O (director and officer) cases, investment and shareholder disputes, securities disputes (with a focus on cryptocurrency) and intellectual property disputes. She holds an MBA from the University of Chicago’s Full-Time MBA Program, and leverages this commercial skill set and her cross-border experience to advocate effectively for clients. She is actively developing her practice in newer technologies. She has written for the Harvard Journal of Law and Technology regarding the execution of judgments on the blockchain.
She takes a keen interest in alternative dispute resolution, and understands the importance of a creative and/or nuanced approach to handling disputes, where appropriate. In addition to her arbitration work as counsel, Zhener has also sat as mediator in, and mediated to successful settlement, multiple cases spanning the contract, tort, construction and employment arenas. She remains active as a mediator on the Singapore Mediation Centre’s panel of Associate Mediators, which she was selected for early in her career. She successfully settled, via videoconference from the US, a Singapore High Court dispute involving sensitive facts, where one party was an NYSE-listed company's national subsidiary.
In addition to her state bar admissions, Zhener is admitted to practice before various US federal courts, including the US Court of Appeals for the Ninth Circuit, the Northern, Southern and Central Districts of California, the Southern District of New York and the Central District of Illinois.

- Acted for major Chinese and Asian corporations against big technology company in a US$300 million quantum dispute in ICDR international arbitration.
- Acted for US Nasdaq-listed company in D&O control and tortious interference dispute before the Wyoming federal and chancery courts. Briefing contributed to new case law on derivative action standing and corporate governance issues in Wyoming.
- Acted for investors in a securities class action over a stablecoin that had raised more US$1 billion, before the California state courts.
- Acted for leading consumer and household goods retailer in patent and trade dress litigation in the Central District of Illinois, taking over in expert discovery phase.
- Acted for judgment creditor in Rule 60(b) appeal to set aside judgment before the Ninth Circuit Court of Appeals.
- Defended technology company against copyright infringement, unfair competition, breach of Digital Millennium Copyright Act and other claims, in a dispute that involved questions of AI authorship.
- Obtained pre-judgment attachment of New York real estate and other assets in aid of approximately US$30 million HKIAC arbitration award.
- Acted for a cryptocurrency exchange against hackers in injunction and enforcement proceedings before the New York federal courts, as well as in AAA arbitration. Obtained preliminary injunction, award and subsequent enforcement of award as judgment.
- Defended electrical product manufacturer against allegations of patent infringement and breach of settlement agreement, before the California district courts.
- Acted for a biotechnology company and its director in defending breach of contract and tortious interference claims before the Delaware Chancery and Delaware state courts. Successfully got claims against director dismissed at motion to dismiss.
- Acted for former directors and shareholders of a Nasdaq-listed company in a control dispute involving elements of fraud and cross-border pyramid conspiracy allegations, before the Delaware Chancery Court and Delaware Supreme Court.
- Represented a Burmese-Singapore corporation in an international arbitration involving a shareholders’ dispute over a multibillion-dollar Southeast Asian power project; Counseled client through sensitive environment in the midst of ongoing government partnership, foreign court proceedings and press coverage; Coordinated strategy with Burmese counsel, experts and business partners.
- Represented North American technology company in international arbitration over joint venture dispute with state-linked Chinese company, governed by Chinese law; issues included transfer of technology and licensing disputes.
- Counseled US corporation in arbitration over agency-related claims in billion-dollar Middle Eastern power project.
- Represented a Southeast Asian sovereign investment corporation in a US$300 million complex securities and biotechnology investment dispute with an Australian public company.
- Managed a cross-border team across multiple jurisdictions to achieve an amicable US$15 million exit by founder and CTO of multinational technology company.
- Negotiated exclusive franchise in Singapore for famous Spanish frozen yoghurt brand, against contentious backdrop. Counseled client through complex intellectual property issues, dispute risk and difficult franchise clauses.
