Biography

Jonathan Tomm's practice focuses on energy and utilities regulation, dispute resolution, and commercial litigation. Jonathan has appeared before the Alberta Utilities Commission and has assisted in representing clients at all levels of court in Alberta, the Federal Court, the Land and Property Rights Tribunal, and the British Columbia Utilities Commission. 

He clerked at the Alberta Court of Appeal before completing his articles with the firm in 2019.

Before attending law school, Jonathan obtained a Ph.D. in political science from the University of British Columbia, where he also taught as a sessional instructor.

Jonathan has acted in the following matters:

  • Alberta Electric System Operator (AESO) - on numerous electrical transmission tariff and energy market matters related to transmission rate design, energy storage, interties, contributions in aid of construction, and energy market rules. Assisted with representation before the Alberta Utilities Commission and the Alberta Court of Appeal. 
  • Consortium of pipeline shippers - in a tariff proceeding involving disputes over pipeline cost of service, depreciation, and abandonment costs.
  • Oil and gas company - on a $1.8 billion claim for misrepresentation and de facto expropriation. 
  • TELUS Communications and TELUS Health Solutions - on matters before the Alberta Court of King's Bench and Federal Court. 
  • Land development company - on an expropriation proceeding before the Land and Property Rights Tribunal related to a parcel of land in Calgary.
  • Electrical distribution utility - defending an arbitration claim focused on contractual interpretation within the electricity regulatory framework.
