UK Government amends definition of exit day in European Union (Withdrawal Act) 2018 to 31 January 2020

On 30 October 2019, the UK Government made the European Union (Withdrawal) Act 2018 (Exit Day) (Amendment) (No. 3) Regulations 2019.

The Regulations amend the definition of “exit day” from 31 October 2019 to 31 January 2020, in order to reflect the most recent extension of the Article 50 period by up to three months. Subsequently, legislation that would be triggered on exit day (e.g. the repeal of the European Communities Act 1972 and aspects of retained EU law) is deferred until the revised date for the UK’s withdrawal from the EU.

The Regulations came immediately into force after being made.
