Biography
Nathan Lapper is a senior associate on the litigation and disputes team, with experience in a broad range of corporate and commercial matters, including issues related to breach of contract, negligence, corporate and societies oppression, and real estate and leasing disputes. Nathan also has experience in public and administrative law, regulatory enforcement and expropriation, including having acted on behalf of multiple local governments, regional districts, health authorities, and public utilities in both British Columbia and the Yukon. He has experience in commercial arbitrations and mediations, as well as both trial and appellate litigation, having appeared at all levels of court in British Columbia, as well as before the Yukon Supreme Court and a number of administrative tribunals.
Nathan is active in the legal community, having previously served as the vice-chair of the Civil Litigation Subsection of the Canadian Bar Association in Vancouver, as a regular volunteer for Access Pro-Bono, and a current member of the Advocates Club. He has also presented lectures to lawyers and other professionals on a variety of legal issues, particularly in the area of municipal and public law.

Nathan has acted in the following matters:
- Fraser Mills Properties Ltd. v. Coquitlam (City), 2018 BCCA 328 (Supreme Court of British Columbia and British Columbia Court of Appeal) – successfully represented the City of Coquitlam in a challenge by a property owner over the requirement to pay development cost charges to the municipality
- Tanaka v London Drugs Limited, Tanaka v London Drugs Limited, 2019 BCSC 1182 (Supreme Court of British Columbia) – successfully dismissing an action under the Occupiers Liability Act involving a commercial premises
- Peninsula (Kingsway) Seafood Restaurant Inc. v. Central Park Developments Ltd., 2021 BCCA 93 (Supreme Court of British Columbia and British Columbia Court of Appeal) – successfully represented the Fraser Health Authority against a claim by a tenant in relief from forfeiture
- SunSelect v. Mastronardi, 2020 (Commercial Arbitration under VanIAC) – counsel for SunSelect in a commercial arbitration seeking general damages for breach of contract and misrepresentation in connection with a supply agreement for the commercial production of tomatoes in California
- Beedie (Keefer Street) Holdings Ltd. v. Vancouver (City), 2021 BCCA 16 Supreme Court of British Columbia and British Columbia Court of Appeal) – successfully represented the City of Vancouver in an application to convert a judicial review petition into an action
- 0976820 B.C. Ltd. v Dorset Realty Group Canada Ltd., 2022 BCSC 988 (Supreme Court of British Columbia), successfully represented a commercial landlord and property manager in claims brought by a former tenant in breach of contract and negligence
- Yard Investment Inc. v Langley (Township), 2018 BCSC 1658 (Supreme Court of British Columbia), successfully represented the Township of Langley in a judicial review and Charter challenge of enforcement actions against an illegal cannabis operation
- City of Whitehorse v. Annie Lake Partnership (unreported, Yukon Supreme Court), successfully represented the City of Whitehorse in a claim in trespass and breach of contract related to the use of city property for an unlawful quarrying operation
- Sanders v Union of B.C. Performers, 2021 BCSC 1820 (Supreme Court of British Columbia), successfully represented a union pension plan in a challenge brought by the union and a union member regarding the interpretation of the pension trust
