Biography
Beth Kitchener is a employment and labour lawyer based in Sydney.
Beth regularly provides advice and represents clients in various types of employment and work health and safety litigation, including unfair dismissal claims, adverse action and discrimination claims, breach of contract claims, enterprise bargaining, re-instatement of injured workers, and prosecutions and defence of work health and safety matters. In the course of that work, Beth has represented the interests of various employers (Government and non-Government) in a number of different State and Federal tribunals, commissions and Courts.
Beth's experience in employment law also includes acting for employers in relation to all aspects of managing and terminating employment and other non-employment based relationships including: award interpretation; breach of contract claims; underpayment claims associated with industrial instruments; workplace restructures; disciplinary matters and grievance issues including counselling processes and termination of employment; the negotiation, interpretation and drafting of employment contracts, independent contractor agreements, confidentiality agreements; restrictive covenants, deeds of release and workplace policies and procedures; advising in relation to requirements for the lawful conduct of workplace surveillance.
Her areas of expertise are: litigation, anti-discrimination and harassment; enterprise bargaining; employment and WHS litigation; and the management of injured workers.
