This article outlines some of the legal concepts faced by investors and African states involved in large energy projects when a sudden change in the legal and economic context arises, and the disputes around these concepts. It also gives insight into two trending issues for energy projects in Africa that could give rise to contractual renegotiations and arbitrations in the years to come.

Canada’s Advanced Examination for Green Technologies
With the suspension of the USPTO’s Climate Change Mitigation Pilot, the Canadian Advanced Examination for Green Technologies mechanism can be used to accelerate examination for a corresponding Canadian application, which can then generate a work product usable for expediting examination in various patent offices around the world using the Patent Prosecution Highway (PPH), reducing the time from patent application filing to grant.
