Biography

Devin Wagner is a partner in the firm's Houston office, where he concentrates his practice on environmental litigation and toxic tort defense. Devin represents national and multinational companies engaged in the exploration and production of oil and gas and the processing of petroleum products. His clients include some of the world's largest energy producers and engineering firms servicing the on-shore and off-shore oil and gas industry.

Devin has significant experience defending product manufacturers and petrochemical facilities in lawsuits involving alleged exposure to volatile organic compounds and other industrial chemicals. He has a wide variety of representation experience in state and federal courts, as well as before domestic and international arbitration tribunals. Devin is admitted to practice in the Fifth Circuit Court of Appeals and in the United States District Courts for the Southern and Eastern Districts of Texas.

  • Authored successful motion to dismiss under Federal Rule of Civil Procedure 12(b)(6) addressing the plaintiff's failure to plead toxic exposure claims against multinational refinery with sufficient factual specificity
  • Obtained summary judgment on the plaintiff's time-barred, toxic exposure claims filed against multinational refinery in Oklahoma federal court
  • Co-counsel for offshore construction company in obtaining award exceeding $18,000,000 in international arbitration against Mexican contractor arising from contractor's breach of charter relating to multi-purpose offshore construction vessel
  • Co-trial counsel for multinational energy company in federal and state court actions alleging claims for toxic exposure and products liability
  • Co-trial and appellate counsel for global engineering firm in defeating motion to compel arbitration filed by international shipbuilder in federal breach of contract action
  • Co-trial counsel for multinational distributor of customized oilfield equipment in federal court action arising from product supplier's failure to tender proper delivery in Saudi Arabia
  • Co-trial counsel for mineral interest owners defending putative class action alleging claims for wrongful withholding of royalty and bonus payments
  • Represented national genetic testing company in arbitration arising from Medicaid provider's failure to reimburse company for testing services provided to Texas insureds
  • Negotiated dismissal of products liability claims filed in Texas state court against national manufacturer of industrial heating equipment
  • Managed the consumer litigation and arbitration docket of a leading electronics and appliances retail company with more than 90 locations nationwide
  • Represented oil and gas production company in a collective action brought under the minimum wage and overtime provisions of the Fair Labor Standards Act
  • Handled numerous hearings in state and federal district court on a variety of issues, including discovery disputes, procedural matters, and jurisdictional issues
  • Secured dismissal of personal injury claims asserted against an international marine construction company for forum non conveniens
  • Represented NASA engineers in proceedings administered by the Department of Justice and the Office of the Inspector General involving allegations of breach of trust and other ethical violations
  • Obtained dismissal of an appeal challenging the enforceability of an arbitration provision in a dispute arising between a commercial real estate developer and national architecture firm
