Biography
Emily Hong's practice focuses on financial restructuring and insolvency matters based in the US. Prior to joining the firm's New York office from Sydney, Emily had a broad range of experience in litigious and advisory matters for commercial and public sector clients, including complex contractual disputes, regulatory inquiries and investigations, intellectual property infringement and issues of consumer and administrative law.

Regulatory inquiries and investigations
- Formed part of the solicitor team assisting a casino inquiry established by the state liquor and gaming authority, which investigated one of Australia's largest gaming and entertainment groups in relation to issues of corporate governance, money laundering, breaches of foreign criminal law and regulatory compliance. Instructed or supported Senior Counsel in 60 days of hearings and assisted with research, evidentiary analysis and drafting of submissions.
Statutory cost recovery proceedings
- Acting for a government authority in multimillion dollar costs recovery proceedings against foreign registered company and its officers. Received favorable judgment in motion filed by counterparty to set aside originating process. As lead associate on the matter, briefed experts and assisted counsel in considering issues, preparing evidence and drafting submissions regarding overseas service, foreign law and rules of civil procedure.
Contractual, consumer law and intellectual property disputes
- Acted for a global information and data analytics company in claims against a competitor for intellectual property infringement, breaches of consumer law, implied licenses and inducement of breaches of contract and fiduciary duty. Worked closely with counsel and witnesses to prepare pleadings, evidence and submissions.
- Advised a mineral exploration company in relation to third-party enforcement of a joint venture mining project in the United States. Worked closely with a Senior Associate to evaluate potential causes of action including shareholder oppression, specific performance, equitable estoppel, misleading or deceptive conduct and negligent misrepresentation.
- Advised a major supplier of agricultural and renewable energy products regarding a series of complex contractual terminations. Prepared pleadings, drafted correspondence in negotiations and reviewed evidence as sole associate assisting a partner.
- Advised a national not-for-profit organization on its licensing and other contractual arrangements, including issues of contractual termination and brand protection.
Procurement, administrative law and other public sector matters
- Advising a government authority in relation to urgent preparation of bespoke asset purchase and emergency assistance agreements with other government entities and not-for-profit organizations. Assisted with reviewing and drafting deeds of sale, variation, ongoing funding of project costs as well as memorandums of understanding as lead associate.
- Advised a State Owned Corporation on administrative law issues and potential regulatory action arising from series of historical approvals and licenses, including developing internal guidelines and communications to stakeholders.
- Acting for the State of New South Wales in multiple civil proceedings and alternative dispute resolution processes in which intentional tort allegations are made against the New South Wales Police Force. Regularly appears in court for directions hearings and works directly with a partner to prepare all aspects of pleadings, evidence and submissions.
