Biography

Giulia Barbone is an environment, health and safety and planning lawyer based in London.  

Giulia has experience of advising clients on a broad range of environmental, health and product safety matters, both contentious and non-contentious, as well as providing transactional support on corporate, banking and property transactions across a variety of industries (with a focus on renewable energy).

In relation to environmental regulatory and compliance matters, Giulia regularly advises financial services firms and companies on ESG disclosure requirements and upcoming ESG regulatory developments. In addition, Giulia provides advice in respect of the UK ETS scheme (including upcoming changes to this scheme) as well as on a variety of environmental compliance issues (e.g., contamination, permitting requirements, waste management and water regulations).

With respect to product liability and health and safety, Giulia’s practice includes advising on product labelling and regulatory requirements, product recall campaigns as well as reviewing companies’ health and safety policies.

Giulia’s planning experience covers advising developers and investors with the preparation and review of planning applications (including mixed-use developments) both in and outside London. Giulia has also represented objectors to compulsory purchase orders, DCOs and Transport and Works Act Orders.

Environment/ESG

  • Advising a major energy firm in relation to upcoming obligations applicable to Energy from Waste facilities under the UK ETS scheme.
  • Advising a North American developer of carbon capture technologies on the applicability of the EU ETS and UK ETS on carbon capture storage and utilisation facilities.
  • Advising on environmental aspects relating to the sale and purchase and due diligence report for a major stake in one of the largest UK offshore wind farms.
  • Advising both EU and non-EU listed and non-listed entities in relation to ESG disclosure obligations in the UK and EU, including the new requirements under the CSRD.
  • Advising directors on licensing obligations for wind farms under the OFTO regime, including issues relating to directors’ liability for board members.
  • Advising a local council on liability exposure in relation to historic land contamination.
  • Advising a North American fertilizer manufacturer and distributor on decommissioning requirements applicable to assets in the UK.
  • Defending a group action brought against an energy company in relation to alleged environmental pollution in the Amazon basin in the High Court.
  • Regularly assisting on the preparation of due diligence reports in respect of major corporate transactions, in particular in relation to environmental permitting requirements and environmental liability for contamination issues. A recent transaction includes advising on the purchase of one of the UK’s largest independent solar and co-located battery developers. 


Product safety and liability

  • Representing a global engine manufacturer in relation to various product compliance issues relating to an EU type-approval under the Stage V Regulation as well as product recall campaign in Europe.
  • Advising a global beverage company in relation to product labelling requirements and compliance with UK labelling legislation.
  • Advising a North American engineering company specialising in industrial automation and life sciences on non-compliance issues under the UK product regulations.


Health and safety

  • Advising companies in relation to fire safety and building safety requirements, including in relation to changes introduced by the Building Safety Act 2022.
  • Assisting with defending a UK company in a fatal accident case in relation to proceedings brought by the Health and Safety Executive.
  • Regularly assisting on preparing due diligence reports in respect of major corporate transactions, in particular in relation to health and safety policies and compliance with health and safety regulations. A recent transaction includes advising on the acquisition of a world leading provider of AI-enabled autonomous systems for defence and security applications.   


Planning

  • Representing a large builders’ merchant in London as statutory objector to a Transport and Works Act Order pursued by Network Rail in conjunction with obtaining a temporary and permanent access point on to the Great Western Mainline Railway project to enable the delivery of the Old Oak Common Station as part of HS2.
  • Representing a party affected by the Lower Thames Crossing DCO during the examination stage of the project.
  • Advising on the promotion of a variety of planning applications, including for mixed-used developments in London and outside London as well as CLEUD applications.
  • Advising on planning aspects relating to the sale and purchase and due diligence report for a major stake in one of the largest UK offshore wind farms.
