Biography

Elsie Cluskey focuses her practice on a variety of construction and development projects, including condominium and multi-family residential housing developments, health care facilities, manufacturing plants, warehouses, hotels and resorts and entertainment facilities. She represents owners, developers and contractors in the negotiation and drafting of development, construction, design, engineering and related agreements. Elsie also advises clients during the course of projects on contract enforcement, legal compliance, preservation of claims and defenses and preparing for impending disputes.

Elsie’s experience also includes the prosecution and defense of construction-related issues, breach of contract, mechanic's liens, design and construction defects, architectural and engineering design errors and omissions, project delay and liquidated damages and performance and payment bonds.

Elsie is admitted to practice in Missouri and US District Courts for the Eastern and Western Districts of Missouri.

  • Drafted construction contracts using guaranteed maximum price, cost plus, lump sum and other forms of contracting for condominium and multi-family residential housing developments, hotels and resorts, health care facilities, manufacturing plants, warehouses and entertainment facilities.
  • Advised one of the largest non-profit healthcare organizations in the United States in development of design-build agreement.
  • Prosecuted and defended other construction-related issues related to breach of contract, mechanic's liens, design and construction defects, architectural and engineering design errors and omissions and performance and payment bonds
  • Assisted one of the largest nonprofit health care organizations in the United States in the investigation, remediation and subsequent litigation of claims resulting from defective conditions and associated project delays.
  • Advised contractor in pursuit of claims against the US Army Corps of Engineers for delay, force majeure, defective specification and other disputes.
  • Represented owners of commercial warehouse facilities in investigation of defective concrete floors and recovery of damages resulting from same. 
  • Represented owner of multi-family housing development in pursuit of damages for defective construction.
  • Represented owner of multi-family housing development in pursuit of liquidated damages for delay.
