Biography
Peter Forrester practises energy, regulatory, Indigenous and ESG law from our Calgary office. Peter has over 30 years combined experience in industry, as a partner at two leading Canadian law firms, and in legal advisory roles for leading energy infrastructure and commodity marketing companies. He was responsible for thousands of kilometers of pipelines, terminals, power facilities, rail facilities and project development throughout North America.
Peter has extensive experience with major facility applications and associated environmental and permitting processes, including pipeline mega projects, carbon capture and storage projects, powerline transmission facilities and hydro, solar and wind projects. He led regulatory applications for some of Canada's largest energy and pipeline developments, and has represented clients before the CER, NEB, AER, AUC, BCUC, BC EAO (now the BC Energy Regulator) and the Saskatchewan MER. He has appeared before all levels of Alberta courts, led regulatory appeal processes in the Federal Court of Appeal, and appeared before BC's Supreme Court.
Peter has also had the privilege of consultation and engagement with over 100 Indigenous communities throughout Canada, including negotiating agreements from impact benefit agreements to equity inclusion in development projects.

Matters in which Peter has acted include:
- Advising a project developer on a carbon capture and storage development
- Advising a hydro-electric dam developer on indigenous matters, including equity inclusion, and related regulatory matters
- Representing a pipeline company before the Canadian Energy Regulator in a complex multi-party dispute regarding commodity ownership, competition and tolls and tariff issues
- Representing a pipeline company in a Canadian Energy Regulator dispute regarding facilities interconnections and toll and tariff matters
- Development of a Canadian Energy Regulator approved safety loss management system for multiple pipeline companies
- Lead indigenous, regulatory and environmental approval matters for the Trans Mountain Pipeline Expansion National Energy Board and British Columbia Environmental Office approvals, and multiple ancillary approvals. Work included engagement and consultation with over 130 Indigenous communities, numerous Impact (Mutual) Benefit Agreements and multiple Indigenous procurement agreements. Work included leading legal and regulatory team in successful defence of approvals before federal and provincial courts
- Lead indigenous, regulatory and environmental approval matters for Kinder Morgan Canada's Trans Mountain Anchor Loop project, twining the then existing pipeline through Jasper National Park
- Lead regulatory matters before the National Energy Board in relation to the reversal of the Cochin Pipeline System from north to south propane service to south to north diluent service, including amendment of the Presidential Permit
- Lead regulatory and environmental approvals for multiple terminal and pipeline facilities for Kinder Morgan Canada, including the Edmonton, North 40 terminals, Jet Fuel system and the Corridor pipeline before Alberta and B.C. regulators
- Working with multiple Indigenous communities, conclude right of way agreements and permits related to pipeline and facilities on Indian reserve lands
