Supreme Court judgment impacting planning decisions for fossil fuel projects

Our disputes and energy teams have written a briefing note discussing the highly anticipated judgment in Finch v Surrey County Council [2024] UKSC 20. This decision will have a significant impact on planning decisions for fossil fuel projects, after the Supreme Court found by majority that when assessing a planning permission application for the extraction of oil for commercial purposes, a council should have taken into consideration the greenhouse gas emissions that will occur from the combustion of the oil produced.
